HAWAII

When a state legalizes adult-use cannabis, it is acknowledging that public interest has turned against the continued criminalization of cannabis. However, simply repealing the prohibition of cannabis is insufficient: millions of individuals across the U.S. still bear the lifelong burden of having a cannabis record, and tens of thousands are actively serving sentences for cannabis-related convictions. The push to legalize adult-use cannabis in Hawai’i has increased over the past two years but the state needs to ensure that any legalization bill include processes for state-initiated record clearance and resentencing for individuals who have been criminalized during prohibition. Get started by writing a letter to your governor and learning more about the state of cannabis justice in Hawai’i below!

In 2019, Hawai’i decriminalized the simple possession of cannabis. However, to this day, nearly 40,000 individuals still carry a criminal record for cannabis possession in the state.⁣ But now, Gov. Green has signed HB 1595 into law! The bill will now create a pilot for the creation of a state-initiated expungement process for individuals with non-conviction records for cannabis possession.⁣

“We are hopeful that HB 1595 will show how a state-initiated record clearance process can provide relief for residents who have been criminalized during the War on Drugs so that they can finally move on with their lives.” —Adrian Rocha, Last Prisoner Project Policy Manager⁣

We look forward to continuing to work with Governor Green and legislators in Hawai’i to create systems that can provide retroactive relief for the tens of thousands of individuals who have been criminalized during prohibition.⁣ Thank you to Rep. David Tarnas who championed this bill and for being a leader in cannabis justice.⁣ Read more on our

WRITE A LETTER TO YOUR GOVERNOR

Americans on both sides of the aisle support pardoning those with cannabis-related convictions. But the public needs to pressure their governors to do what’s right. Through our Pardons to Progress campaign, you can urge your governor to deliver bold action and immediate relief by granting clemency to the tens of thousands of people still incarcerated for cannabis in your state.
